I thought I will share my experience with all members who are facing processing delay for their I-140. My I-140 was filed at NSC on March 21, 2007 and got transferred to TSC on May 21, 2008. Since then, I see no activities (I believe TSC was treating transfer date as receipt date and they didn’t bother to look at my case). On July 29, 2008, I asked my Lawyer to initiate the inquiry about the delay and his paralegal took the “service center request” from USCIS for my I-140 and service center issued a confirmation number (ETCXXXXXXXXXXXXX) for further inquiry.
Within 10 days of initiating the inquiry, my case was approved on August 9, 2008. Please do so if you think it will help.

You make it sound like they care about you and are doing this slowly to get everybody on board, sorry to burst the bubble but chances are they were able to apply the right pressure at the right places and get this passed.
Fashion models and Sport personnel and EB-5 folks are few in numbers and will go unnoticed by their constituents. Other EB categories are comparatively huge. So I suppose that congress is treading carefully. If the bills does not go though the subcommittee and full ones, opponents will debate that the bill was sneaked in or piggy backed or pushed through. Hopefully something will emerge before the presidential elections. Lets not loose hope and try our best. Anything after the elections will be bound to be bogged down by CIR...

Did use the technique mentioned here and was able to send the flyer to all new agencies in less then 5 minutes.

depends on javascript to force you to send only 5 messages at a time.
here is small shortcut:So switch off javascript
on IE go
Tools>Internet Options>Security>Internet>Custom level>Scripting
Close the browser and open it for again for your state.
also the format is like this if you want to send numerically

Cornyn said today. �USCIS�s announcement this year that the cap for H-1B workers was met in just one day, coupled with the recent July announcement that employment-based visas were no longer available for those with advanced degrees, makes clear that industry needs interim relief today until we can return to comprehensive immigration reform. Specifically, the Cornyn Amendment would allow the Department of State and DHS to �recapture� unused employment-based visas. This is not an increase in employment-based numbers but rather, a direction for the agencies to use all the visa numbers that are available today. These visa numbers will be distributed to nurses and physical therapists and aliens with extraordinary ability, advanced degrees, and needed skills. In addition, the Cornyn Amendment also includes a one-time H-1B increase of 115,000 (up from the 65,000) for FY 2008 only.
So maybe the H-1B provision killed it??

Instead of wasting visa numbers , they should allocate to those who cleared namecheck and all other processing. Agreed, this might allow a person who started PERM in 2007 to get gc in hand in 2007 itself compared to a person with PD 2001 EB2 , applied I-485 in 2003 and stuck in name check. But it is better than wasting the visa numbers.

Dreaming on the April Visa Bulletin in the US
How about placing a fast forward button and soon you will realized that the US Immigration DOS will issue a spectacular Visa Bulletin for April 2009. See the results of the said bulletin. The Employment base Visas will be current except China. So how did the USCIS allocate these number of Visas, for sure Obama had precedent a recapture except China.

Well this is very confusing.
What if a person files the I-140 after May 15th and his/her I-140 is approved. Later assume that I-485 date becomes current for that particular person (before Oct 2008), he/she files for the AOS/I-485 (before Oct 2008). While the I-485 petition is pending the date Oct 2008 comes what happens then? Will this nulify the filed I-140?

My labor was approved 8 months ago. Although i submitted all the documents to my attorney 5 months ago My employer is yet to file. the fact is i am eligible to file for 140/485/ead/ap. So now i am stuck. Will this affect me.Thanks in advance.:mad: :mad: :mad: :mad: :mad:

This is really a bad news especially for those whose PD is between 2004-2005.Its like those who are waiting for a long time are being asked to wait more!!
