My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

It would be risky.F-1 visa requires strong ties to homeland. Since your parents are already here, it would be difficult for you to prove that you will indeed go back to India on completion of your studies.

From Metro Weekly: Following up on reports from this weekend, Metro Weekly just received confirmation from Christopher Bentley, the spokesman for the U.S. Citizenship and Immigration Services, that cases of foreign partners who are married to a same-sex partner and would otherwise be eligible for a green card are on hold in light of questions about the continued validity of the Defense of Marriage Act. Hello Friends
My husband was an employee of a desi company and they had withheld part of his salary, he filed a complaint at the DOL and got the pending money back.. that was 4 years back.. now he is trying to change his job and the new employer wants to do his background check..
what will show up in his background check? will the case against his employer affect him? we are really worried about this.

I got my H1-B visa on June 29, 2005 , I came to india on Jan 2009 . From Jan 2009 till now I have been staying in India , bcoz I was taking care of my new born daughter, now she is grown up and now I am planning to start working in US. Right now I got my H4 visa .
I came to know from someone that H1-B filing for this year was over in Jan 2011, so if I need to file a new H1-b , I have to file now and I will be eligible to work after Oct 1 this year. Is it true ? Is it not possible that a company files for a new H1-B under premium processing and I start working after 2 weeks of filing ? I don't want to wait that long(Oct 1) to work , I have few oppurinities coming up where I may get selected.
I have stayed in india from Jan 2009 till APril 2011. Now I am on H4 visa in US. Can I get a extension of my previous H1-B visa filed on June 2005?
I want to work ASAP.

Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.
Is there any way of getting the documents from USCIS or is it lost forever?
We will have the interview next Thursday, 21st of February.

There is no expiry date in his I-94. What should I write? Is it like D/S (F1)?
Name and address of present employer (if any) for my husband.
Should I write Graduate Student or leave it blank?

Recently my husband had received an RFE on I-485 requesting information about his employment verification letter. He had sent all documents back to USCIS and today, I saw an update on my case. The message read that case processing resumed and there will be a decision or update made in 60 days.
Do you know what kind of decision they usually make? Is it normal to have such statements written up for a denial or approval?
Any words of comfort would help. My husband is the primary applicant.

My wife, who is a US citizen, is filing for my immigration tomorrow, and along with it, she is also filing for my Adjustment of Status (And Advance Parole as well as Employment authorization). She would file it at the Chicago dropbox tomorrow. I am on a B2 visa here.
I would like to know how long would it take, or how long does it averagely take these days, for the AP and EAD to be processed in a case like mine.
I saw another thread about processing time of AP, but that was for AP renewal. In my case, it would be a fresh AP and EAD.
Thanks a lot to all in advance.

A bill has been referred to the committee and sponsored by Sen. Sessions.
Sen. Sessions is very anti-amnesty, and looks like he is pushing a bill for the legal immigrants-in-waiting. We do not yet know the contents of the bill, but hopefully by later this week, the text of the bill would be available in the library of congress.
I think given the current political environment we can get the senators and house representatives to vote in its favor.
Lets see what the actual contents of the bill are tomorrow/day-after.

I sent my 485 to NSC in July 2007 and got the receipt from NSC after 2 months. I filed my wifes 485 in first week of August 2007 to NSC but got the receipt from TSC. We live in Texas but our employer was from NJ when i applied 485. After that we have been applying for EAD and AP regulary at respective service centers with out any issues.
1. Has any one been in this situation and got their GC approved?
2. Do i need to request my wife's application to be moved to NSC if that can be done?
I am few days short of getting current and hope this doesn't delay approving our cases.

I recommend the Nikon 18-70 AF-S DX zoom in that price range. Right now I use the older 24-85mm f/3.5-4.5 zoom on my DSLR, and find that I frequently use the 24mm extreme and wish it went wider. If you do lots of interiors and don't need a very wide angle of view, then one of your suggested lenses would be better due to the larger aperture (keep in mind that 28mm on a DSLR equals the angle of view of a 42mm lens on film).
