I have a question regarding AC21 portibility. I got my EAD in Oct 12th 2007. In the labor(used a pre-approved labor), the base pay mentioned is 48K and I was getting paid 55K from my current employer(A) who filed my green card.
I am getting another job in company (B) in the same field. The salary offer is better but is very high than mentioned in my labor. The new salary is around 85K.
1) Will the high salary will cause any issue with green card process if I take AC21 and use my EAD. Anyone had this kind of experience with the salary difference.
2) How do I know my new job is in the same or similar category as defined by USCIS.
3) Is AC21 is safe to take.

I am currently in the US on H1B and want to pursue higher studies. Can someone please let me know the supporting documents that are required for COS.
Do I need my original
1. Transcripts/Marksheets
2. Experience/Relieving Letters
3. Tax Returns
4. Bank Statements for 6 months
I am asking this because i dont have these documents with me right now and I want to apply for a Change of Status immediately. I know that the above are all required to file for a F1 visa
Would appreciate a response.

South Carolina Republican Senator Lindsey Graham has said many times in the past that the GOP needs to move back to the middle on immigration reform. He's putting his money where his mouth is and is leading the GOP's pro-immigration wing as they work behind the scenes shaping the bill likely to be introduced in the next few weeks. For how long you are waiting for GC and for how long you are willing to wait more for GC?
A lot of people have been for a long time. That is the reason IV has formed to eliminate/minimize the wait.
I don't think any one is willing to wait here !!!!

I am on 8th H1b extension with approved I140 and 3yr extension. Now I want to join a new company, who does my H1B and will get 3yr extension on that. If my parent employer revokes my I140, will my new H1B (with new employer) gets void ? or is it still valid for me to work with new employer for next 3 years. I dont want to apply for LC and I140 with the new employer as I will be R2I in August 2007.

With predictions that the H1B cap will be reached any day now, employers and employees are rushing to beat the cap. United States Citizenship and Immigration Services (USCIS) announced that, as of December 4th, it had received approximately 61,100 H-1B petitions counting toward the congressionally-mandated 65,000 limit. Additionally, USCIS has approved sufficient H-1B petitions for foreign nationals with advanced degrees to meet the exemption of 20,000 from the fiscal year 2010 cap. Any H-1B petition filed on behalf of a foreign national with an advanced degree will now count toward the general H-1B cap of 65,000.
So why are they still accepting cases? Well not all filed H1B petitions will be approved so the final count will not be known until USCIS will clear all denials. We will keep you posted.

I recall that USCIS was planning to issue 2 year AP and 2 year EAD. I see that the 2 year EAD has been implemented. ANy idea, if and when the 2 year AP implementation is expected?

Hi,
I graduated with Masters in Dec 2008. We have 29 month OPT. My OPT ends in June 2011.
So, I believe we have 3 chances for applying for H1
April 2009
April 2010
April 2011
I have not applied in 2009 and will not apply in 2010.
If I apply for April 2011, will I have any trouble, as my F1 ends in June 2011. I guess H1 starts in October. So, in between June and October , will I need to travel out of country . My University says, it will not be trouble. Please explain.
