It was the figure that the Kauffman Report found about a month ago when studying the potential for Reverse Brain Drain amongst other things. It as accurate a number that you will find.
Remember, this is many years of cumulative build up of temporary work visas transferring to permanent residency path

We know that cases that are current and not stuck in FBI checks are being approved farily fast, so my gut feeling is they have maybe 50-80K EB cases in active adjudication. I already mentioned in my previous posts (multiple posts with same matter for people like you and me, see it and understand it well) how we are getting more than 50k visas just for EB2 India. I am giving it here again the visa allotments for 2006 and 2007 years when theres vertical fallouts. Now its changed to horizontal fall outs.
Due to this as many of us think its not the EB3 India which is losing, but its EB3 ROW.

We can argue over a few thousand here and there but the increase will be substantial as compared to prior years. The big caveat to all this is that USCIS/DOS continue the horizontal spill over from this point on.

Really an interesting issue to talk about. I came to this site via google search. I am in the same boat. I am living in country for 14 years (F1 and now H1) with SSN. My wife never worked here; so she has H4. We have a daughter born here with SSN. We could not get this "stimulus rebate" because we filed "married filing jointly". I understand from IRS site that if you filed "married filing separately" you would get the benefit and you can later on amend your filing as "married filing jointly" (04/14/08). This may be beneficial if you "itemize" your deductions. You will still qualify for excemptions. But, if you do not itemize your deductions, your standard deduction will be halved if you file "married filing separately".
We filed married filing joingly and received our tax returns and no stimulus rebate. Can we re-file our tax return by filing separately this year (i.e. extension/amendment within 3 months?) Has anyone done this? Please let me know.
I would love to a part of any legal battle to raise our concern. Please keep us posted. I plan to check this site regularly. Also, please keep us updated with getting SSN for H4 visa holders.

People with EB3-India may not expect any kind of fast movement in near future, unless law changes. It will be in snail phase. It is waste discussion to analyze howmany people filled EB3 LC from India in 2002,2003 etc. Generally EB3 is very high demand catagory from all accross the world. EB3 contains skilled worker catagory including cooks, nurses, and so many many non-professional occupations. All the discusion are focussed on demand by Indian IT folks, by ignoring other spectrum of the demand by other group of peoples. Therfore no matter what; EB3-India will get only 3000 EB3 GC per year (Approxmatly 1500 primary).
1500 LC per year EB3 India is a tiny fraction of the demand by EB3 India. Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
Only when EB3 ROW becomes C can EB3 China, India & mexico see a leap in priority dates. March bulletin 08 pushed EB3 ROW by 2 years. Apr bulletin pushed it by another 6 months to Jul05. If demand for EB3 ROW is still low, then final quarter of this fiscal year (Jul to Sep), priority dates for India EB3 can possibly see a jump forward by 1-2 yrs.

Me and my wife applied for AP renewal on the same date, my wife received the receipt notice but I haven't received mine yet. It's been almost 10 days since we sent the documents to USCIS Nebraska center. even the check isn't cashed out yet. Did this happen to anyone? any suggestions guys??

140 reached NSC on July 11.
Receipt date is July 17, attorney says they got it today, July 24.
So for those at NSC who filed within a day or two of me, mght be better to hold off for a couple of days before filing 485 with the colored sheet which will probably add some delays in the mailroom

Is fragomen filing EAD & AP on time?
I have been following up with them to file my EAD renewal since 10 days and today I received a response that they are busy with audit and will do as soon as they can, I don't want my ead application to be delayed, its already more than a week I was eligible to file EAD renewal.

Hey I have the same issue - did you have any issues to get ur visa stamped for company A. I am leaving the country for a 2week vacation and have to get my visa stamped. I never joined compnay B even though the visa transfer was approved last august. I am still working for company A. A reply would be appreciated. Thanks

I am on 8th year H-1B extension and my labor certification application
is pending at PBEC for 4 years..
Got Laid off....from my current employer...What are my options ?
a) Can I get an H-1B from another employer and apply thru PERM.
b) If I apply thru PERM from another employer B and my labor is approved from my current employer A(the one that laid me off)...can I apply I-140 from the employer A ?
Guys...Pls let me know you thoughts ...It is very critical for me...

I got to know from my attorney that, USCIS has my I 140 information in their system and they gave him a receipt number. But, the receipt is not generated yet. It may take a week or so to get the receipt. My appl was filed on 12th and it reached NSC on 13th.
I checked the status online with this receipt # and online status shows that they recieved the aplication on 19th and its at Texas center. May be my appl was moved to Texas now.

In future if someone wants to reach us if you have any question, it is better to directly contact us rather than posting on the forum as we do not read every post.
A couple of people who got the letters have already emailed us and let us all review the letter to see if we are getting what we need from this request. Let us all agree if we want to pursue this and contribute towards this. Once we have enough people, we can go forward.
This is one of the positive steps that we have taken here and glad that we got the response from CIS. So now IV needs to get expose this letter as public as possible to get the USCIS tactics out (senate, congress, president, dhs head and all in the world). And if need be that we all need to contribute to the money they are asking. This is the good one.
