If there any IV volunteers around DC, it would good to go his DC office and if possible meet the congressman itself to explain our case.
I am willing to do it. I did call up the local senators and congresspeople about supporting the bills. I have asked the GM of my company to give me some political contacts (am still waiting on him) since he had recently gone to DC to do some lobbying for small businesses. Let me check in the DC/MD forum and figure out who we should target/meet.

I phoned my attorney asking how I can verify if this update was / was not a glitch and according to him my PD should be current for September. :eek::eek: WTF
(perhaps he has an inside person somewhere in State Department).
I also called the service center and IO confirmed it is either approval or green card itself. Since I was updating mailing address as well, we will see how long it takes for approval to reach me.
My attorney said I can do nothing (at the moment) but wait for approval as it should list Priority Date and category as well and only then can we formulate appropriate approach for rescinding / reinstatiting AOS. I have put H1B on hold as well till we get a clear answer.

On a side note, wife had a dream where my GC arrived nice and shiny and it was approved in an EB2 category :D:D
Weird, since I dont think I have EB2 case pending anywhere... Unless my previous employer filed I-140 under EB2...

Here's my Tragic Story.... I just couldn't sleep since Monday !! ! ! !
My PD is May 2003 - EB3 and my stupid lawyer sent it on Thursday ( 2nd Day Air) and it reached them on July 02. Do you think if i have a chance that USCIS will accept it.. I called the Service Center and they didn't hv a clue on it yet... Atleast if USCIS can accept the appln.and provide Ead/AP that would suffice for now..
Any thoughts ????

The messages you are getting from your House reps and Senators are standard messages that they have on this issue.
Please do not be discouraged by the email back messages from them, because frankly it is just an automated standard reply.
The idea really is to make them take notice and hopefully have some body (staffer) read atleast one of our email messages entirely and realise what our issue/s are. We need to make them aware of us- "Immigration voice" as an organisation and educate them on the issues we face. So if we continue to send them messages, that will be a big help and it builds momentum towards the advocacy event.

Well...I am one of us stuck in EB3. I do qualify for EB2 but my employer choose to file it under EB3. I recently invoked AC21 and moved over to a new employer on my EAD. Is there a way I can ask my new employer if they can file new I140 under EB2 and change my category to EB2?
I am also like you. As I have been searching this forum, I understand that you can ask your new employer to process a new EB-2 PERM, once it is approved, the new employer can submit for I-140 with interfiling of old PD of EB-3.

I agree... i dont think its wise to call USCIS about the VB fiasco... the operators are probably minimum wage paid and are reading off of a book/compter screen.. not the ppl who can make decisions.. if it werent the us govt, we would have calling up even lower paid workers in India/Philipines and hearing from them... instead of calling USCIS, please spread the word, create awareness in the political system, press and media..

I just found out that I will not be getting the stimulus as my wife is cannot get a SSN. In addition, we will not be getting stimulus amount for our American born daughter.
We have been here for a year and a half and while there are some benefits to being in America, my wife and I are trying hard to understand why we moved here from Canada (saving taxes is no benefit when compared to having to deal with ignorance all around). My being here is benefiting an American company (which did not have the expertise that I brought to them and this country) and thereby this country.
If I were to leave the company, a number of people would lose their jobs and I would take my expertise somewhere else.....
Is it true that almost everything done in America is poorly planned and lacks foresight and common sense? Our experience here to date is giving us this impression.....
I would be interested in joining with others against the IDIOTS who don't understand who is benefitting this country.
I totally agree with you. I came from Canada too and my wife went to college here, got her nursing degree and RN. Not able to file for GC because of the mess. She is working in an industry which has high demand and lack of people. Health care will be worst for those American baby boomers. Waiting for my kids to go to college ( 4 more years ) and move back to Canada.
Came to USA only for kids higher education.

A ton of EB3 cases with early priority dates came out of the BECs in 2006. Plus the end of labor substitution acted as a trigger for people to use these priority dates. I know my company systematically went through and substituted newer filers so they could get these older priority dates.
Also, although a lot of people are moving from EB3->EB2, USCIS needs to process the new I-140 and recapture the priority date for them to get an accurate picture of the EB3/EB2 queue. There is a largish I140 backlog today.

Therefore best advise in EB3 India folks to convert into EB2 to get use of early PD like 2002 or 2003.
This is like telling passengers to move to the other side of the boat when it starts sinking one side. The outcome is only making the boat sink faster. Remember, the huge backlogs are not completely due to unavailable visa numbers.
Unless there is a real need, moving from EB3 to EB2 dont make much sense.

Can someone confirm if you can maintain accounts in the US after you leave. That sounds very dumb. I want US to keep my money and they don't want it?
I understand that after Patriot Act you can't open accounts in US without SSN but I think you should be able to keep your account because that SSN is assigned to you forever.

I am not sure about effect of patriot act, but some of my friends who left in 2002 era still have accounts here. Another friend left for Banglore but his 401K is still here.

I have been going through this discussion. I am in a similar situation where I got a Welcome Notice saying my I-485 was approved and I should be receiving my card in 3 weeks when my PD is not current and in fact, the PD is a couple of years behind! It has been 6 months since I got the notice and no GC is in sight. After calling the customer service in March, they told me that they did not have my biometrics in their system and so I had to go for a biometrics appointment early April. It is almost 3 months since then and I still have no GC card. I know that there is a delay in card production, but at the same time, I am wondering if the I-485 approval was by mistake and that is causing the real problem. I am in talks with a lawyer who suggests it is better to correct the USCIS mistake right now rather than getting into complications in the long run. I am frustrated that I have to pay for an attorney for a mistake USCIS did and concerned what will happen in future when I proceed with their advice.
Could one of you who faced this situation descibe how you handled the situation or how you would handle this situation? In my case, there is no other I-485 or anything filed before and I have never been out of status or had any issue ever.

If we have filed our cases earlier - We have every right according to me to get our cases approved before others.. If they leave status current till everyone labors are approved (According to backlog center Sep 30 07) - That would resolve the issue/confusion.
If a clause exisits for us mentioning our 140/485 would be accepted next month would resolve the issue - any thoughts!!!
