Me too!
From http://www.parlipro.org/table.htm definitions it does not seem that bad to lay on the table. Seems to indicate that it can be taken up for vote and establishes a priority over newer motions(amendments in our case). May be I need a law degree to understand this.
I am confused. it is very contradicting.

Thanks for the reply and the blog!
Regarding your answer for question 3 - when you say "renewal" what does it mean? There is just one application form for I-131, so should I simply fill out the same form regardless of whether the previous AP is current or expired?

needhelp! I have never met you but from seeing your effort in the fund drive I know you motivate people.
Keep up the good work, with time your state chapter will be one of the best.
Shame on those who RSVPed and didn't show.
Our current situation is dire. Even a back of the envelop calculation of wait times for a lot of us seems unreal. Being inactive in the only organization that speaks in our voice is just not being smart. We cannot let laziness take over and live in denial of the immigration mess.
For the members who do not want to volunteer for IV activities, the least you can do is contribute to the IV funds.

I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.
We can help! We want to make sure as many people as possible come to the rally. Those in worse financial positions can take advantage of the many generous offers from other members who are willing to sponsor others.
You have one offer on this thread already http://immigrationvoice.org/forum/showthread.php?t=12441 - check this thread out for more. Yours is a compelling story, and we'd all love to hear it first hand!

Equal Employment Opportunity applies only to applicants who are eligible to apply for that job. It does NOT apply to immigrant visa allocation (aka I-485 approval).
If you don't agree with this, I would suggest spending $200 with an attorney to get initial consultation and get the answer to enlighten yourself.

If you want to change the law, go to congress.

And whats with big lawyer names? Just because a lawyer has a website and writes on a website, does not mean he is a big lawyer. Look beyond the marketing of lawyers and see their skills, track record and genuine concern for your long wait. You are asking the same lawyers to help you whose bread and butter comes because you are applicants in a long line.
Highly educated innocents!

There were approvals on July 1st and July 2nd for PD which were current according to the earlier released visa bulletin.
This does mean the earlier bulletin was valid for few hours and the applications received during that period should be valid!!

Even though I am an EB2 filer and very happy to see the Eb2 movement, I feel sorry for EB3 guys. Hopefully Eb3 will start moving faster soon. This is good news but we should focus on our current priorities and help IV core members to accomplish our main goal. Yesterday only I contributed to IV and I hope rest of the members do the same.
Good luck to all who are current.

As I promised earlier I would keep you guys updated on the process of this case.
On saturday I received the welcome as a permanent resident to USA letter. After trying to get a hold of my attorney I got in touch with him.
Heres the story. (this guy is a genius)
I asked him how it was possible when my PD wasn't current I got GC approval.
His answer was funny and pleasant. Magic :D
He said after the approval of my PERM during filing I-140 under EB2 he also filed a petition under "person with extraordinary ability interest to US" on my behalf. So in other words both the petitions were being processed together at USCIS. Me not aware of USCIS rules wasn't aware of all the lingo so didn't know.
Now the Extraordinary ability petition quota is always current. So when my extraordinary petition was approved the attorney informed the USCIS that to adjucate my adjustment based on this approval. Since the PD was current for this category. USCIS processed and approved the GC based on that. I love this guy I don't have to work for my current employer anymore hence he will get a big surprise when I turn in 2 day resignation. HA...

USCIS is clearly requesting for two passport size photos with AP application.
It is surprising that most people don't even read basic instructions with the USCIS forms, and go on asking questions and sometimes giving (wrong) suggestions in IV. Yeah, it takes a few minutes to look through the instructions but searching/writing/replying/ doubting/making mistakes/giving red dots/ etc in IV takes more time, I think. :)
I e-file my AP and I got receipt notice immediately after completion of e-file. And I got the direction on the PDF listed bellow. USCIS clearly mentioned DO NOT send Copy of ID, Photos unless they requested. Thats why I didn't send any documents to USCIS.
6) DO NOT mail photos or copies of identification unless requested to do so by USCIS.[/COLOR]

because for people from Aus, their spouses can work.
There is a different visa category for australians called E1, only THOSE ppl's spouses can work. If an australian is on an H1 his wife cannot work on an H4 either.
In that case you also have to argue, why H4's cant work but L2's can? :)

my company might use this one and i have no say on this. just wonder whether the new york office is good in regard to GC process.
FRAGOMEN SUCKS TOTALLY - but unfortunately I got no choice - my employer uses these morons for immigration services. My reasoning is based on my experiences below:
1. I have been mailing Fragomen for 3 MONTHS (YES THREE FULL MONTHS) to initiate my H1 extn 6 months prior to my visa expiry cause I had a need to travel outside the US in a short notice and I did not want to be stuck because of me not having my visa extn papers in time. Despite 5 e-mails and 5 voice mails - there was no response from FRAGOMEN. Escalated this with my company and we had a conference call to discuss this issue with Fragomen. Guess what FRAGOMEN's Client Service Manager had to say when I asked her about they not answering my e-mails and voice mails for 3 months - "I CANNOT ANSWER THIS QUESTION SINCE EVERYCASE IS DEALT DIFFERENTLY AND WE DECIDED TO INITIATE UR H1 EXTN 3 MONTH PRIOR TO UR VISA EXPIRY." WTF!!! Who the hell are they to decide on my professional/personal travel needs? I really wish I had their job - do nothing at all and when questioned say "I cannot answer that question".
2. To make sure FRAGOMEN do not mess up my 485 as well, I asked them in the same call the time they would take to process and file my 485. The client service manager promised me that they would file my AOS in 4 business days from the day they receive all the documents from me. I made sure I sent all the documents including Medical Exam results in less than 2 days from the day we had this call. Guess how long they took to file my case - 3 full weeks - 15 business days!!!!
For the kind of money they charge, the service is totally bad. FRA-DON'T-GO-MEN might be a better name these guys.

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)
*
This is my situation-
I worked for 'Employer #1' from Jan-2000 to Jan-2005
Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2
*
However, I thought of changing job in 2006 and 'Employer X' offered me a job and sponsored my H1 and it got approved too, but I changed my mind and decided to continue with my current employer (Employer #2) and I am still with Employer #2. Please note my latest H1B was sponsored by Employer X, but I never worked for this Employer.
*
Please advice-
1) What should I send to USCIS? As I dont have (cant get) Employment Letter, Paystubs and W2 for Employer X
2) Would you consider this as simple case or complicated?
3) Should I hire attorney? (I self filed my 485 in July-2007)
*

This is the exact text - (changed Employer names)
Service records indicate that you were granted an H1-B nonimmigrant worker classification for employment from DEC 11, 2006 to DEC 11, 2009 for Employer X"-. However, according to the G-325a submitted with your application, you had only worked for "Employer #1" from Jan-2000 to Jan-2005 and for the "Employer #2" from Jan-2005 to the present. Please provide evidence that you were employed with Employer X". Such evidence may include copies of: employment letter, pay stubs or w2s
Thank you for your time and help.
Your post absolutely doesnt make sense. You are asking us here "485 RFE and USCIS asking paystubs for employer you never worked"
This does not seem to be a 485 RFE but a H1 RFE. Put some sense into the post before posting here and confusing people. How can yours be a 485 RFE when employer X never sponsored your GC and when USCIS is asking paystubs from Employer X for H1 transfer and when your GC is still running with Employer 2. Senseless post.

I am not sure if it is only me.....but many times I see strangers wishing me or each other morning, evening...."how u doing" ,,,etc....
but Indians (I am also an Indian -:) are a little reserved....I do not see a greeting from fellow Indians that easily.....again I am not saying Indians are bad (cause I too am one -;)
maybe it is a culture thing for us not to greet strangers ?
PS - I have had my share of experience where non-Indians are also sometime rude me to me .....
This is from Justin Webb -- BBC's long-time Washington Bureau Chief:
Now back in the UK I find myself utterly at sea - I say hello to people I pass in the street. They lunge on, muttering insults. We'll get used to it.

I wouldn't make that decision until Oct of 2008.
My personal opinion and analysis tell me that EB2 will soon get retrogressed from what it is today and the picture will not be that rosy in a couple of months.
I would wait until Oct 2008 and see what kind of visa numbers are available at that time for EB2 and EB3 and them make any decision on switching.
Again..just my opinion.
