Since you are a Canadian you can apply for a visitor visa (B1) – by applying the visa we will be in legal status until a decision is taken. B1 visa is generally approved if you give the reason of finishing up matters in US (like selling house/cars/closing bank accounts/credit accounts etc). I guess you are asking just to be informed but if it really happens another option for you is TN1 – if you have not yet applied for 485.
But they never know when you leave really, at least if you're canadian. By going home, all I do is give the CANADIAN immigration officer the i-94 paper with the h1 stamp when i enter canada if i don't plan on returning to the US again, at least on that visa. Plus, they never ask, so it's really up to you to give it to them. And getting a visitor visa, canadians automatically enter on 6month visitor status as default, no stamping required. If you're flying, all you have to do is tell them you're coming back to canada. If you drive across the border, they don't care to ask. So i guess i can just hop back to vancouver for a weekend and come back as a visitor and be fine then (to clean up affairs, or just hang out for 6 months).

Though your feelings are ok, the reality is different.
1. yes there are lot of capbale people through out the world earning less than what an average person earns in US. Why any country should provide visas to them if the country does not gain anything from it. Better to know the supply Vs demand concept.
2. Being a very capable person, you choose to be on H4. US did not force it on you. Everyone has the option of going back to their home country or wait here till they get what they desire. You weigh both the options and decide which suits you better. If you decide to stay on H4 for 4-5 years, then at somepoint for some reason you thought it is better than going back. So be practical.
As someone said, one should feel deserved to get GC and not beg for it. Again I am sorry for your status. My wife with CA and CPA and she is on H4 for 5 years now. I know how frustrating it will be. Worrying will not help much. Accept the reality and think calmly which way you want to go in your life down the line in next 5 years. Take actions now for that which may end up in leaving this counrty or staying with current status until you get GC. You have to make up your mind to live a peaceful life.
This GC process will throw anyone into depression.

I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.

We had several threads crying out for funds in very critical time senstive times. At those times you are a mere spectator and now just for posting this bashing post you reluctantly became a anonymous member. All these shows your LEADERSHIP skills and quality of leading the battle from FRONT. If I were in USCIS I would do a background check on these high qualities and ground breaking positive attitudes even before giving H1.
I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!

Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.

I guess it's not about service. It's about job professionalism. There is no problem with Air Hostess or employees, but it is management. Let me give snap shot of my exp.
My flight was from Bangalore --> Bombay --> USA
Flight took off at Bangalore 60 mins late. Staff reassured that flight in Bombay will be waiting
Once we reached Bombay they took boarding passes and tore them off. They said your flight already left, you have to go next day. Some passengers noticed that few passengers are still boarded into US flight with flight nbr given in our boarding passes. When everyone made an issue about this they said, it's overbooked so we can not accommodate.
So their statement that flight took off was literal lie which is unprofessional. Also they deliberately delayed Bangalore flight which also they did not manage nicely
Then they said go to Delhi there is a flight. We reached delhi there is no flight. There AI staff said not sure why they sent you here. Only option is next flight starts tomorrow. Next day they listed the flight but again they say it's cancelled due to technical difficulties and part has to come from other country and you can fly only tomorrow.
By that time there were passengers of 2 days waiting. when every one made a big noise, they arranged a flight after 4 hours.
They should have made alternate arrangements before all this mess and 2 days of waiting. Consider people with infants.
I understand unfortunate things happen but deliberate lies due to mismanagement and moving you around just to buy time is completely unprofessional. I did not find this kind of unprofessionalism in other airlines, even though there are other bad experiences with them also.
There will be millions and millions of experience like or worse than this brother so dont worry. Next time while flying make a point to put on your worst attire and treat the trip (flight) as if you are going to a barber shop or meat market. Dont expect courteous behaviour and neither be courteous. In airports havn't you seen people dressing up as if they are going to present at an international seminar and also behaving as if they are meeting with the president?? That needs to change. That is a place full of desperate employees serving a bankrupt industry and so be prepared to experience the fallout of their economic woes. Yes I agree they (airlines) had a good time but it was a long time back. Concord is gone and so are all the goodies that come with flying. Long time back most of us used to get thrilled when the flying date gets near, right?? Now not even a retard looks forward for flying. Flying is the last option and only done when absolutely necessary. Everybody, almost every single person who ever flew had some kind of bad experience so what is the probability that you will also get it......100%

even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.
IMHO, I would always say, if it is legal and possible and beneficial, ppl should think of conversion.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

the "core group" does not much exist in practical terms right now. there is instead a large "leaders group" that helps coordinate actions and strategy.
this group has a lot of active members- and i find it "comfortable" to say that the majority are EB3. which may actually count for something- since i actually do know somethings you don't :-)
no one stops anyone from doing anything. but whatever you do (and yes you actually have to DO, not just keep talking), has to have a sound basis. Many of the suggestions put forward have flaws, and actually papu and others have been pretty helpful in politely helping to point those out and suggesting changes. of course reddog took objection even to that! incidentally, just for the record, you may want to look at pappu's profile . HE IS EB3!

in 2007 ordinarily, (like 06) EB2 I and EB3 I would have got only 2,800 GC each. because of iv's efforts in reversing the july bulletin, EB3 I got a huge number of Gc instead. many more than any other category. i don't remember anyone else standing up and saying that this was unfair and that iv is all about EB3I. and that's what a lot of anti iv folks say. that iv is all about EB3 India. so this is very ironical.
and i see here a comment that every campaign has been bad for EB3 india.
i guess july reversal was bad. i guess the campaign for recapture is bad. and the 2 year EAD is bad too. not to mention the gathering support to end country quotas.

Thank you for that info. I was not visiting the forums regularly then, and the only time I saw it was when IV core was already supporting it and encouraging everyone to do it. I have seen many great ideas on the forums.
Flower campaign wasnt started by iv (atleast not by the seniors), it slowly gathered momentum on its own and produced results. After seeing this bulletin I ve lost hope in all this lobbying and stuff. We need publicity and more of it. Fasting for a day if organized by iv could bring more results.

I went to SSA office today and they did not accept the application. I had all the necessary paperwork such as SSA guidenace on Non-Work Purpose SSN, Letter from IRS (one that every taxpayer got informing about Economic Stumulus Package) and FAQ regarding Basic Eligibility and ITIN for Economic Stimulus Pakcage from IRS website.
They simply refused to accept the application. This is unacceptable as I do not think lawmakers envisaged such a situation when they announced plans for Economic Stimulus Package.

The only reason they refused your application is that you are an immigrant. You can therefore file a discrimination complaint against them using the form I attached in my earlier post. But until it becomes true she may be considered as good wife and Mother.She is inexperienced that is true but if we consider that Obama also inexperienced. So it is just selecton of better evil. But Politicians here is much better transparency,less corrupt,better skilled than majority of countries in the World.

There is something about politicians who cannot pronounce the word "nuclear" properly. They all seem to somehow become Presidents. Maybe we should start pronouncing the word "nuclear" differently, it may help us to us to become president. :D

It depends on the occupation, obviously for a welder or cook level II will be pretty low. For say a mechanical or electrical engineer or physicist - entry-level position requiring a MS degree the max level will be level II.
For positions requiring PhD or MS+experience it will be Level III or IV.
In conclusion, an applicant for such a position can be classified as EB2 even if wage is at Level II.

By this and a later post MC is showing openly brazen attitude toward EB3 applicants. Such posts should be first of all, banned from IV and I am going to report all such posts.
Based on Visa Bulletin report, it seems like massive retrogression is likely for EB3 as well as EB2 :( for the rest of the year. Many have ported and some hibernating applications are now active. :(

When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.
I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.

But if we raise our voice against porting, they will raise theirs with double the intensity against spillovers. So I dont think we should throw stones on their houses, when ours are made of glass. Moreoever if we see the statistics, there is a HUGE # of EB2 applicants in 2007 onwards I think. Unless we all act together, its not going anywhere.
I know many cases where newer applicants applied in EB2 and were much lesser in hierarchy than their bosses who are in EB3 and waiting. I think we must respect that, and more importantly as soon as raise our voice, they will not keep quite, right. You would also not keep quite if in their shoes.
Best will be if IV comes up with some programs to reduce this backlogs.

People with EB3 applications should be allowed to port. But these should be EB3 applications which were genuinely applied and not substitute labor which opened during July 2007 fiasco.
Because a EB3 application with substitute labor in July 2007 has a priority date of 2002,2003,2004,2005 or even 2006. Where as a genuinely applied Eb2 prior to that, had the qualifications / job requirements before July 2007 and they are still waiting.
USCIS should realize their mistake in 2007, it encouraged a pay to play scheme, which is putting genuine people at great disadvantage.
Porting like any option was started with a good intention, but because of loop holes it has lost its meaning. There are people who landed in this country during the July 2007 fiasco, paid for the labor and have green cards in their hands now.
Or at least provide the same level of stringent requirements to port like (EB2-->EB1) . Technically a EB3 can port to EB1 also, but porting to EB2 is easier. That way Eb3's can consume Eb1 number and stop spill over to Eb2.
L1A is another one, where people qualify as global project managers with very minimal effort, could have less experience than a EB3 or in some cases they have reported to people in EB3 queue here from 2002 and are ahead of the EB3 within 6 months.
Understand the realities here: IV is struggling to make even the most legitimate views heard and you are sitting and talking away as if USCIS and lawmakers are your servant. Go for the ONE thing to wish for that will solve all troubles, because you have only one chance.

The CRAB STORY also applies to EB3. Whenever somebody talks about spillover to EB2, all the EB3s are against spillover and making comments that it's not happening this year. It feels like EB3s do not want EB2s to get GCs. If porting is legit, then spillover is also legit and EB3s need to accept that.
Porting was always there and porting must not be more than 300/quarter this year (other wise EB2 PD dates would have retrogressed or gone back). Porting was not something started in FY2011 or FY2010. However, I do accept that the frequency of EB3-EB2 porting has increased slightly due to more US companies outsourcing IT jobs (bad economy -> more outsourcing to reduce costs{check the stock of CTSH!} -> demand for consultants -> resulting in firms like CTSH and small consulting companies agreeing to EB3-EB2 porting to keep talent). Outsourcing will not always result in all the US jobs to completely move to outsourced countries (I guess smart people in this forum already know that).
There will be spillover this year and EB2 PD reaching DEC 2006 by end of FY2011 is a real possiblity. There is no need for EB2s to get all worked up when somebody ports or EB3s to get worked up when somebody talks about spillover. There is GC pie for everybody. Just be patient or do something to solve fundamental problems with GC process ( by participating in IV campaign).

My 'Employer #2' H1B I-94 and 'Employer X' H1B I-94 numbers matches with I-94 number that I got at 'POE'.
Receipt Data is July-2006 for 'Employer X' H1B.

Could you please provide following info
1. I-797 dates for Employer 2 and X
2. Last Date of entry in USA
3. Date when I-485 was filed
I-94 number being same does not mean much. One can have same I-94 number for COS from H1 to F1. On the other hand, one can have different I-94 with H-1B transfer. Typically, H-1B transfer means new H-1B petition for the beneficiary who is/was in H-1B status and is not subject to H-1 cap.
If beneficiary's initial H-1B was counted against cap in last 6 years, then subsequent H-1B petitions are not subject to cap and usually referred as H-1B transfers.

sorry, i missed the obvious. In the links i posted earlier and also on I-131 instr page, it clearly states that Bio-Metric is a must for 1) Re-Entry doc and 2) Refugee doc, but not Advance Parole. duh! :-)
But i think when u e-file they ask for FP even though its Advance Parole.
im paper-filing now wiht no FP fee.
