Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.
3. Suppose there is a delay in getting the renewal, you are NOT allowed to work until the renewal comes through. Renewal duration depends on the work load.
4. Fee of EAD is being hiked to $340 per year.
5. Couple of my EAD starting date was the approval date even though the current EAD had not exipred effectively loosing couple of months validity each time.
6. Due to some issues if I-485 gets revoked the EAD/AP are invalidated the very next moment and you accumulate illegal stay and would not have time to get the process going.
On the other hand having a H1B you can apply for EAD any time or not even apply if you have sufficient validity on it. Suppose the I-485 gets rejected you can reapply for a new one or from an another employer and still work/live legally in the US.
EAD allows you to work any type/number of jobs that is the big PLUS though!

Sorry for late jumping on this old topic. But, applied for SSN for my wife and got it in mail. Now what? My taxes for last year were applied in feb this year. How can I tell IRS that my wife got SSN now and she is eligible for Stimulus package?
Can I claim this amount next year when I file my taxes?

Speed of approval is not the problem. The NUMBERS are the problem. We saw that in June when so many ppl got approved.

:eek: I am not sure whether it is my HR to be blamed or my corporate law firm TheChugh who has been handling my case, no one has bothered to convey my PERM status or even my case #. I feel frustrated when my HR doesn't respond about the status.
I understand that they must by flooded with application preparation but setting up a link for me to check the status shouldn't be very difficult.
I really hope that my PERM gets approved before 31st July so that I can file I-140 and I-485 concurrently.
Anyone else has experience to share about TheChugh law firm?
Even I have some bad experience with CHUGH Firm..They are really slow and never talk...I think they don't pick the call even if they are around...

joining the club...
my I-485 was nicely pending @ TSC, and the company just sent H1 papers off to VSC for processing, so I can come back on H1. I am currently sitting in London (working for my GC employer from their UK office), when I got the Card Production E-mail. My previous H1 approval expired in March.
My EAD will expire next month, as well as AP. So, here is the rub, they will not let me come back to US on AP since system shows GC approved, H1 will be rejected since GC is approved.
needless to say PD is not current. I kind of remember having an approved RIR Labor with PD June 2004, but I dont remember having sent for I-140...No idea what to do and how to check that.
Dont trust company's lawyer, and I sent all I-485 papers by myself back in July 2007. I have an attorney that I bug from time to time but he is on vacation now...
So... am I completely screwed...?

Ok. Visa bulletin for December gets published. We are all shocked or surprised by the cut off dates. So, we decide to bash USCIS, run all possible permutations on visa numbers (how many different ways are we going to continue analyzing 140,000 visas), some have even proposed fasting and there are some who are threatening to move to Canada or India (I am not sure who is stopping them).
Let us analyze all the proposed solutions and see if they will really get us anywhere:
1. Bash USCIS: I am not sure if anyone at USCIS or the administration would care. You can stand at the top of Washington Monument and scream and not a single soul will care.
2. Analysis/Paralysis of available visa numbers and the possible movements: USCIS, the department that has access to all the required data is struggling to forecast visa availability, but, I see my friends here with very limited access to data trying to forecast Visa movement. I can bet, even with all the smart PHD�s here that we will not be able to forecast visa availability even, if we built the most complex model and continue to have limited access to data. So, this is just an exercise in futility.
3. Fasting in front of Governor�s office: Great idea! We can work off all the excess weight that we may have put on that we have gained due to over eating (one of the symptoms of stress or depression). I think we are choosing the wrong time of the year to do this. It is cold outside and I am not sure if anyone would even stop by the poor souls to pour us a hot cup of coffee. However, we may gain some publicity. Better than idea 1 and 2.
4. Moving to Canada or India: Please do and USCIS will be glad that they have one less case file to deal with and Numbers USA or Lou Dobbs will pay for the ticket.
Unless we stop these frivolous discussions over pathetic suggestions to fix the problem we will continue ignoring real solutions.
We need to think and execute with a sound long term strategy (12-18 months). Let us not try to eat the elephant in one bite. Let us fix this problem with small, manageable and doable steps.
I hope I do not offend anyone. I think it is time to be serious about the road we take from here.

First off it is quite frustrating with people not participating and not putting their money where their mouth is. However, on a constructive note, screaming at people for behaving the way they are behaving rarely gets them to meekly surrender and start doing the right thing. Whether people do it out of their own free will or after persuasion, it take courage for people to participate. What works is to look at the problem and not to personalize the issue. So poor participation is the issue. If you are consistently not getting enough people to attend then it makes sense to delay the frequency of the meetings as one option. The other option is to call people and ask why they were unable to attend and give them a chance to come for the next meeting. Maybe the projection of rounding up x people was based on poor assumptions. So setting realistic expectations and then building momentum from there is the key. This is a dry tough fight. We need to set up tangible goals which break the vision down yet show the grassroot level people how the baby steps will lead to success. Most people in my opinion, back off because they do not see a realistic connection between the baby steps and the final vision. I think if we treat this like a challenge and try to understand the underlying problems, this movement will have a better chance at success. Regards, JH

We have worked hard in the last 4 years and have made some progress along the way Immigration Voice Achievements (http://immigrationvoice.org/index.php?option=com_content&task=view&id=5&Itemid=47) But Most of us are still in the limbo of green card process and waiting in different stages. Some of us may have advanced to the I-485 stage and have a little more career flexibility but the hanging sword of uncertainty still looms over our heads.
Our angst, our insecurity:
Even with EAD and other options, lack of green card is lack of security and lack of certainty. You know it and you feel it every day. In order to find a permanent fix for the uncertainty, angst and insecurity and in order to snap out of the probationary lifestyle and career, we have to finish what we started over 4 years ago -- get the U.S. Congress to act on this problem and solve it once and for all.
Early effort wins:
The first agenda of next Congress will be immigration and we expect an immigration bill to be debated sometime in early 2011. However, it would be a big mistake to wait until that time to do something about that bill. Successful advocacy efforts are the ones that start early and introduce concepts and ideas into the debate before the legislators write their first draft. Once the committee hearings and debates begin, it is harder to get changes or fixes into a bill because it requires an amendment to the bill in a politically charged and heated atmosphere. Groups and organizations that wait until the last minute to influence members of congress often fail to achieve results. In order to succeed in next year's immigration bill, we have to begin talking to members of congress now. Remember, the advocacy efforts we did with lobby day and rally in Sept 2007 influenced congress to include our provisions in bipartisan bills introduced in Aug 2008. Legislative things take time.

You and help in two different ways:
Join the advocacy effort in DC on June 7th and 8th. The problem is, most of the women population on H-4 here have never thought of taking it up. Infact they should take the initiative and the husbands should cooperate. Folks, IV is a platform to come and work on the common goal. It is not a platform to come and abuse it by blaming it just because you do not have a green card till now. Come join us and help out. Be an active volunteer and work on daily basis with us to solve the problem and make IV better. We need more real workers on the ground than strategy advisers, critics and Management consultants.
Enough said. Actions will speak louder than words and you need to get involved to tell us your ideas. A friend of mine transferred his H1b from company A to company B. He applied for the H1b transfer and then started working on company B. His H1b from company A expired while his petition was pending with USCIS. He received an RFE after 3 months. Company B responded to RFE but received one more RFE for the previously responded RFE. Now my friend fears that his H1b transfer petition may be denied. Would it be possible for my friend to return to company A and apply for H1b under premium processing even though his H1b with this company expired couple of months back? He has been working all this while on the basis that his petition is still pending with USCIS. Any suggestions or advise would be much appreciated.

This "anand" guy is a psuedonym for a Kim Berry crony for all we know.Old timers will notice that his distracting messages bear a striking resemblance to the folks who attacked IV core on the day of their CIR success. Such folks are not worthy of a personal response from IV core members - their time is too valuable for that. Hell, Roy Beck and Lou Foulmouth don't care to respond to our emails, do they ?
