Been here since August 1995 - came on F1 undergrad
Glad to see there are people like me on this thread. I came to the US in FEB 1995 as an undergrad. I have an MS today and dropped out of the PHD program (2000) to find a job because of recessions. Survived 3 top-notch companies, recessions, despicable back-stabbing coworkers, unethical and unworkable environment, lay-offs, legal dept messing up my H1b application making me go on unpaid leave (~3wks) without health insurance, filing me under EB3 while applying EB2 for another coworker from a diff country with the same job title, etc etc....my rear end is pretty soar these days and I am beginning to question all this....

Has anyone done refinance from BOA on EAD / AOS (expired H1B & I-94)?
My current home loan is with BOA & I am trying to refinance with them, but they say we can't approve now because of status. I locked in rate in Sept. 2010 & now I am stuck as rates have gone up. After 4 months they have denied.
I don't know how to proceed further. They are not ready to give any letter & the lending policy. Any suggestions please......

So, who ever gets to apply I-485 are in much better shape than people with PDs in 2002 or 2003 but do not file I-485 now.
REMEMBER, USCIS USUALLY DO NOT FOLLOW ORDER AND YOU HAVE TO BE VERY LUCKY OTHER THAN TURNING ALL THE RIGHT PAPER WORK.
Obviously if a guy with PD 2002 or 2003 does not apply there is no way he can get the AOS approved.
But do you mean a guy with PD '2007 May' applies now and a guy with PD '2000 March' (for some unkown reason) applies in 'Oct 2007'. Assuming that the PD cut off date retrogressed to '2000 March' then the guy with '2007 May' PD but with RD '2007 July' would be in a better shape than a guy with '2000 March' PD but with RD '2007 Oct'.

For the ROW category, the manual seems to indicate that they have a general date (such as in the Visa Bulletin) but I would expect that they have many visa counts for each country..... Anyone have a quick synopsis of how they handle that?

I think this is a valid question that is being asked and should be answered by IV core. Am always intrigued by our behind the scenes effort and the heck that is going on. I do not want to cross the line and judge the integrity on IV core, but would really like to know exactly what we are up to. At least we need to periodic conf calls and announcement of our efforts (and I understand there needs to be some secrecy with anti-immig watching us closely).
Though IV core has been doing a great job, with the huge member base is it really leveraging the member potential except for donations and stories? May be there should be a change in the strategy leveraging the members thoughts and putting things in perspective. Chances are a few new team members could bring new energy and strategies.

I was stuck in backlog center.
Recently my company converted from Non-RIR to RIR and I got it approved
in a few months. In parallel, I had my labor approved via PERM too as a safety net, just in case dates become current.
I would personally suggest to change your case to RIR if it is not so and there
is no harm in getting PERM approval as well.

I have been wanting to post this for the last few days and was happy to read this thread.........can we do something like an Immigrant's Boycott Day or something where we should do a mass boycott all over the country.....we need to coordinate this across the entire country and do a gandhi style protest.....but we need atleast maybe 1000 people per city to do it.....I am not sure how difficult it is to get that many people.....but that seems to be the only way to create an Impact.......WE HAVE TO MAKE OUR EMPLOYERS FEEL THE IMPACT OF NOT HAVING US FOREIGN WORKERS.....THAT IS THE ONLY WAY TO STOP THIS EXPLOITATION........its like when all the mexican farmers stopped working on the strawberry farms.....there were no strawberries in the market....I am in the Detroit, MI area.... we need to come up with a list of big cities where we can get 1000 people per city.

You are saying that authorities will take retaliatory measures for saying something that really bad happened. Then dont even talk about lawsuit etc... Do you think a lawsuit aginst USCIS/DOS is going to please them very much ???

in weekend of 48 hours (consuming 25000 visas) which takes even more
than 48 days definitely involves bypassing CRITICAL checks !!

What the hell on earth is this? Do you know for sure they have ignored it? Do not add masala to the existing crap. Do you understand the consequences of these kind of spiced up stuff? We all would be sulking in the security check for ever, if DHS gets pissed off or gets a congressional hearing and the authorities get lambasted over this. You are seeing how doctors are being implicated in UK and all over. Security is the most important thing right now on this planet and western world is agog over security. I dont know from where Greg Siskind and Jay Solomon got the tip off. They tipped each of their hats off and put the story in our brains to run the show. Security is not a Joke. Do not make it a bigger issue unless you dont know whether it really has happened. The consequences can be pretty dangerous to the extent of revoking all the issued GC's in the past 20 days, if congress gets high on this. I dont know what lawyers want, but my understanding is none of us want to have negative consequences of this issue.
No matter who screwed up, we should be conveying the following message after we say that USCIS/DOS goofed up.
"The root cause of the situation is the inability of
a) DOS/USCIS to recapture the visa numbers from previous years
b) to carry forward the unused numbers for atleast one year
If congress makes the needed legislative changes to solve the above two issues, USCIS/DOS will not be in the ugliest predicaments like they are in right now"
Its our choice to make USCIS/DOS our enemies or we get compassionate to the situation considering how arcane the current laws are. We agree or not, we have to work with them going forward. Just that they are down and we are on a bashing spree right now doesnt mean that it will be situation for ever.

i think the quality of education is not that big of a deal. both countries do well on their sides. it is the rewards associated with a certain type of education that is important...it just so happens that while people of our generation (mostly generation X) were studying management/law/finance in US, people in india were studying engineering/science and math...that being the rewarding career of choice for the masses in respective countries.
Indian people are doing well here as a community and will do well in years to come. this is because they saw opportunity and freedom as they never saw before in this country...they wanted to make the best of it and couldnt wait to do an excellent job and in turn reap rewards of honest hard work.
Unfortunately due to the protectionist business environment before 1992, before Manmohan Singh then finance minister open the economy for free trade the economy couldnt generate sufficient opportunities for the masses. that is the reason why people took great efforts to immigrate to US and achieve great success.
what we see today in India are the good effects of free trade policies which started in 1992. It took almost a decade to see them conspicuously. i am so happy that India now offers promising careers to its engineers that were very scarce 15-20 years ago.
