The text for HR 5140 Economic Stimulus Act 2008 has the following eligibility criteria:-

I think you guys are current with the Aug bulletin only (EB2 India has been on Apr 04 for a while)...I was asking for folks with BEC EB2 with PDs that have been current for a while but still not received their GCs. WOuld be interesting to know and also gives an indication of how fast really USCIS adjudicates applications once they become current.

I called USCIS and she said based on the information she got from his authorities, she said all the 485 application packets will be rejected with a note saying that , please apply after oct 1st if your PD is current.
I also asked her if you dont send us back by oct 1st what sould we do, she said if I dont receive by August mid, then take infopass and go to local uscis office and request for my application back.
I think all the customer service agents are aware of the issue and got informed what to answer for our questions.
I BEG to differ. I called USCIS today morning and the rep told me VERY CLEARLY that ANY application received on July 2 will be ACCEPTED as July 2 is the cutoff.
A few min later my spouse called and they told her, Everything would be rejected.
USCIS customer service center, currently cant differentiate their A** from a hole in the ground!!

I have never seen such a horrible law firm. I and my wife both are working for large corp. I am on L1 and my wife on L2 EAD. Our sutuation is same as majority of yours

I have updated the front post to reflect our meeting information.
Now lets start on the game plan.
We would need some help from our leaders here..... what are the crucial topics that shall be discussed, and who are the people in state that we should target?
I think, calling our senetors and possibly arranging a meeting with them would be on our top of the list. But lets meet and discuss first to decide what points shall be covered, and what shall be avoided....etc...

People that have been saying that IV supports this and not that please re-look at IVs agenda, nothing is hidden. The stated agenda is to try to make the employment based process better, the ENTIRE process. A piece meal approach does not work (proven in the past by legislation that tries to fix a portion of the system). The holistic approach may appear to be locally sub-optimal will be the best for the entire employment based community.
In the interest of full disclosure and at the risk of incurring more back lash I must state that I am in EB2-I category.

I dont mind if the congress passes a bill and says it's going to take 6 yrs for a person to get his GC..its the uncertainty around retrogression thats bugging me. If I know it's going to take 6 or 8 or 10 yrs, i'd gladly look elsewhere..perhaps even go back to my home country.

you dont need to pay anymore money for EAD when you apply in future. this is what my attorney said. Thats why USCIS fees is very high and its one time fess for EAD and AP.
I don't think that's true. You pay every time for renewal of AP/EAD. Its a nonstop source of revenue for USCIS.

And SOA, if urs is not a labor substitution, u better send another i 140 application along with ur i 485 as concurrent filing. No harm in doing it and u will be safe side.
I think 140 cannot be filed twice as it needs original labor.
So i guess we shud try to send a proof that it was filed and reached uscis on a specific date.
