Hi,
My huband is working in H1B in USA? In most of the job boards they ask this question:
Are you legally authorized to work in the country in which you are applying?
what should i specify yes or no? Can somebody explain? Please it is urgent?

Hi,
I'm in H1b since March 2006 and it Expired in March 2009. Got extension Until Sept 2009 Only (as per RFE and client information).
( I'm about to deliver a baby in Oct 2009, so I need to be in the country atleast until Dec 2009)
1) If my further extension were to be denied (touch wood), say that decision was made by USCIS in Nov 2009,
Can I do COS ( change of status) to F2 or B2 visitor once I came to know about the denial?
or
Do I need to initiate a COS when the case is pending?
or
Do I need to initiate a COS when I have a valid status, say in Aug 2009 itself?
2) Assuming, I do COS successfully from H1b to F1 ( say in Oct 2009)
Then, in Feb 2010 would I be able to get back to H1 again with the same or different employer? without needing to wait for Apr 2010 quota to open?
3) Also, when a H1b is denied does it mean that the person has to wait to get into another cap? or
can they still apply for H1b year round as they are already counted in Cap sometime before?

One of the bigger myths floating around regarding DREAM is that it will lead to chain migration. The thought is that DREAMers will get citizenship and then quickly sponsor their parents for green cards. Not quite. We got the EAD receipt for both of us.My EAD Status says card ordered but my spouses EAD is still pending. Any one in a similar situation? FP Notices receive for both of us.

just got my GC. Now if I contract for a security clearance job, like Armed forces, or Defense related one through the same employer that sponsored by GC, CAN I BE ELIGIBLE for a waiver of the 5 years waiting period -to what extent is is waived ....100% or only part of the 5 years wait, if at all .
My Company is a US Defense Vendor .
Can someone pt me to the right place where all this is clarified.
Also would the same kind of waiver apply if you work for a Govt agency or it is strictly defense...
are there some other ways where GC-> Citz can be expedited

I had a really good experience in Nogales last week, I got my visa stamping on the same day of my appointment and the NVS International team was great. Hello - I just recd. the TRANSFER NOTICE for me & my wife's 485 case stating that the case has been transferred to USCIS-NBC, PO Box 648005, Lee's Summit, MO 64064. We had filed for AOS in July 2007 and my priority date for is April 2006 (EB-2).
I would appreciate it if somebody can please shed some light on what this means for us. What are the implications for us.? Will the case be transferred to the local office.? Should i start to gather documents for a interview.
Would appreciate any advice i can get. Thank you!

I think you have the wrong information. Senate is not ready to vote on it yet. S 2198 which is a part of PACE and holds relevance to the employment based immigration is still in committee hearings.

I came to US last December to visit my family by a tourist visa. during the time that I was here I got a letter that showed I won DV lottery. so I hired a lawyer and he told me he will be able to apply for me from here. so he prepared our file before our visa expiration date and sent our file. but we got rejection notice and he said this is because of sending it early. he did the same 3 times but each time we got the same rejection notice. now he says that we are out of status and our case is dismissed!! As i checked USCIS office, we were not able to send it before November according to our case number. now I want to know what should I do? is it really over?
