Hi,
Me and my wife went to India and I came back one week back with my ex employer visa without any problem,I had to show only the I-797 for the current company where I am working. My wife she is still in India coming back to US in September.
I am sending my I-797 original to her in the mail.
My concern is will the immigration officer ask her for my I-797 approval or her I-797 approval ( she is on H4). We don't have an I-797 approval for her as my H1 was applied before we got married.My current H1 is expiring on Jan 19th 2009 so we applied for extension for both of us and got the approvals but its only valid from Jan 19th 2009.
Any replies greatly appreciated.

Could anyone share their experience/knowledge about getting home loan on EAD? My bank says that, for non-FHA loans, you need to be in any of the visa categories like H1, TN1, GC, ... But its list doesn't include EAD or Adjustment of Status. Can that list be challenged to include EAD? That is, how to convince the bank/lending inst that EAD is a legal/legitimate status like H1?

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

My current AP expires on July 30, 2008. I am planning to apply for renewal in Jan or Feb 2008, which is 6 months prior to expiration. I understand that nowadays it takes more than 3 months for approval.
In case of emergency, Can I travel to India with my current AP while AP renewal petition is pending?.

This is not really a surprise and it's not because American doctors are in any way inadequate. However, while virtually all US medical school graduates will eventually go on to practice medicine, residency and fellowship slots that go to J-1 and H-1B doctors are filled by doctors who generally finish near the top of their medical school classes. Americans who worry that they are getting inferior medical care going to a internationally-educated doctor should feel more at ease after seeing this data. One group that didn't do well - American-born doctors who go to medical school overseas.

Hi,
I am on EB2+PERM. I got LC approved and currently filed for I-140 and 485.
As I understand unless the I-485 is pending for more than 180 days after the approval of I-140, I have to restart the whole process again with the new employer (expect that I can port PD if I want to).
Now are there any chance that if the above scenario happens, and my employer did not revoke I-140 or 485, that I can still receive my GC? Or that will be illegal? Please clarify.

Last year I signed affidavit of support forms for my parents and they are already got their immigrant visa. One of my friends needs my help to sign affidavit of support for his brother. My question is how many affidavit of supports one can sign for different people? What are my liabilities if his brother later do some thing wrong in USA?

There is a mistake in my 485 cover letter. The letter states that I am EB3 but actually I am EB2.
Will this cause any problem? Will USCIS deny my case? Please note we included I-140 approval form in the file.
