Guys, I am efiling 765 for EAD renewal. last year, my lawyer filed 765 and sent a G-28 along with that. This time, I am efiling on my own, do I need to send the G-28 ?
also, please let me know if photos are required to sent after efiling 765.
my AP is expiring sometime in mid Oct and EAD is expring on 30 Sep. I am efiling EAD on 30th of May, can I do the same for AP though, it will still be more that 120 remaining for AP?

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

This is my current status
I am on H1 B visa and currently working in the US. My visa expires in July, 2011.
I was sent to the US on a long term onsite assignment from the company I was working in bangalore, India. I am asked to come back to India in June 2010.
What are the implications of me quitting thecurrent job once I go back to India? Is my H1 B visa still valid?
In case if I go back to India and move to a different company, do I have to go through everything starting from filing the H1 petition to get the H1 visa?

Hi,
I was an employee with company A till march 2008 and i kept a H1b transfer to
company B on march 24th 2008. I was working to company B for an year
on receipt number applied for h1b transfer at USCIS. I got an RFE with
company B in sept 2008 mean while my I-94 got expired on August 2008.
Company B answered the RFE and submitted to USCIS on October 2008.
After waiting for H1B transfer to get approved it got denied on march 10th
2009.
Now i wanted to change my status from H1b to F1(CPT). My questions are
1. If i apply for transfer from H1B to F1 will i be getting New I-94 from
USCIS?
2. Should i be going back to india for getting stamped after i change my
status to F1 ?
3. Can i be on a student status from the day i receive the receipt notice
from USCIS for change of status ?

I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.
Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?

The case status message for mine and my wife's EAD changed to Card production ordered. It did not change to Approval notice sent. I received the EAD cards within 1 week of the Card Production e-mail. However my lawyer received the Approval notices (wife and mine) first week of October.

My husband has a conviction for domestic violence. he was not jailed but is under probation. he is on h1b visa and i am on h4. his i140 was approved before the conviction. also both our visa extension were approved prior to that. currently visa stamp in both our passport has expired but we have valid i-94. i need to visit india for urgent family health issue. if i go i will need to get a new stamp. Can his arrest result in my visa getting denied at consulate. Or will it create any problems for me at port of entry?. he is not going to travel with me

total of all 1099-misc = gross income
subract all business expenses (Corp/ LLC/ Proprietor)
thats the nett business income to be reported while filing taxes

Does the published cumulative demand data represent
a) all pending 485 cases that include primary applicants and their dependents
OR
b) all pending 485 cases that include primary applicants only?
If say, the demand data for EB3, till 2004 says 35,000 - does this mean there are a total of 35,000 pending cases in total OR does this represent primary applicants only?
If it represents primary applicants only, what is the multiplication factor we need to use to get an approximate number for total pending 485 cases?

I was trying to find out if one can transfer from b1/b2 visa category to H1- B visa within the valid period of stay(i.e before the expiry of the I-94).
Go out of the country and come back in H1 status, provided you have a valid H1-B. (Can go to Canada also). Otherwise, too many hassles. (non-immigrant vs immigrant intent)

Hi,
I need some advice on what are my options.
I have been working with a consulting company since June 2006. I have an approved Perm and approved 140 with the same company.
Before my Perm and 140 were approved we got my H1-b extended till September 2011.
I am planning to visit my home country and need to attend for Visa stamping. I have booked my tickets too.
The problem is my company has recently changed its location and I have the old address on my paperwork (I-797, LCA etc)
But the latest pay stubs have the new Address.
Will I have any problems when I attend for Visa stamping?
Do we need to apply for the ammendment? In that case should I postpone my trip, get the paperwork and then go for stamping?
