I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.

They are worse.. they do not respond quickly, never let you talk to attorneys directly.. have to go through the secretaries and to top all this they mess up the applications.. in short they suck!
I think, many of us go to Murthy.com for the news and latest updates at no cost. This is the best service this firm is providing to the community. I believe, it is most reliable and up-to-date info center (I have my attorney in CA but during last 4 weeks I got answers to my questions from Murthy.com only!).
Whether it is Sheela Murthy or para-legal assistance, it should not matter as long as a right response to a question is given unless someone is looking for a doctor not an attorney in Murthy.com firm.
Let us hear what other thinks.

You definitely raise an interesting case. What I would say to that is that they just have to reevaluate the points allocation system. the details of the point allocation system may be bad but the overall intent still stands to benefit the highly educated while including the EB system as well will make sure less skilled but in demand people are also taken care off. handling family based GC is a whole diff ball game though.

And most people on this forum who rail against the treatment of Indians might want to think about why they left India in the first place. India is by and large an extremely unfair place to live. There is constant discrimination. We left because we wanted to lead a decent life without pandering to someone all the time. Everyone from India on this forum was fortunate enough to be educated enough that they could afford to make that choice. There are a billion people who can't make that choice. And they are in India. We chose to abandon them and come live among what we percieved to be a fairer society. And it is, in a lot of ways. Do not be hasty to judge through the glasses of pent-up frustration about your current circumstance. If you have a personal experience that you thought was not fair, tell them at that moment why it's not cool. And by and large, they will stop or at least empathize with you. Try that back in India - tell your local politician why you think he's not doing a good job and see how well that goes.

It is unethical of AF to blame bad weather. You need to differentiate here - turbulence is okay, thunderstorms?? what the heck.. why would a commercial airlines fly into a thunderstorm
Commercial airlines fly between 25,000 ft and 40,000 ft. Airlines generally take risks for profits. I know it. Some airlines like United are ultra sensitive to turbulence. Some fly right through turbulence. And sometimes I feel some pilots are plain incompetent, they have no control over aircraft during the storm.
I have personally taken 500+ flights, almost 2 every week. And I can say, I get really nervous when turbulence or strong clouds are present. You are one second away from the big jolt or swing. A lot of times, it has been a roller coaster like ride. Now I would enjoy that once in a while. Sometimes I have seen big aircrafts like Boeing 757-300 series, flex, you see forward portion of aircraft going up and tail portion going down. But its required so that aircraft does not split up mid air. It can be a nasty thing for someone seated in the rear. Always always wear seat belt during turbulence, if it gets severe, you will hit the head on the ceiling. The turbulence during take off and landing is usually more risky as aircraft is closer to ground and can not afford to lose altitude. If it is at a higher altitude, aircraft can lose some altitude, due to "air pockets" and still be ok.

I think this guy is from numbers usa for sure. After writing all the BS, he asks it to take it in constructive way. There are lots of other way to express your concern if it had to taken in constructive way. This is definitely not the way.
Based on your comments I could see that you are a regular visitor (FREE RIDER ATTITUDE) to IV site for more than a year. We had several threads crying out for funds in very critical time senstive times. At those times you are a mere spectator and now just for posting this bashing post you reluctantly became a anonymous member. All these shows your LEADERSHIP skills and quality of leading the battle from FRONT. If I were in USCIS I would do a background check on these high qualities and ground breaking positive attitudes even before giving H1.
I think a change of leadership of IV is critical if we have to get anywhere. IV has not been able to achieve a single thing in all of its existence. Not a single thing, nada, zitto, zapata. Not disclosing the issues they are working on, not disclosing how the funds are distributed, not disclosing the lobbyist they are using. Who in the world calls that leadership!
That is the reason that no one wants to contribute. First get some results, show people results for what they have paid for. Then ask for more money. Most people I talk to are confident that IV will achieve nothing given their track record. I tried to convince a colleague to join IV. He bet with me that they will not be able to achieve even this filing I-485 issue. He bet that he will join and pay if they did.
I know IV works like dIVorced wIVes club and saying anything negative is taboo. Anyone saying anything negative is crushed with (p)curses. Only good mushy things are allowed here. So here it is: We will get our GCs by the end of the month. Hallelujah!
But I am writing this for the benefit of IV and please take this as constructively as you can. As a member, I have full right to suggest a change of leadership when I think it can help.

No one is talking about what happened in Apr-2001. Bill Clinton allowed all illegal aliens to file AOS in EB-3 category. That brought estimated 8-10 million filings in Jan-Apr 2001 under EB-3 category. That's why it took so long for EB-3 to get past Apr-2001. With EB-3 having a number cap, I still have a feeling that those estimated 8-10 million are still floating around in the system and dragging EB-3 category. Any thoughts on this?

I'd like to apologize to every level-headed member of IV for getting involved in an ugly exchange of posts in this thread. It was never my intention to distract us from our common goal.

Even if they approve the GC, they can always revoke and ask you to return the card. This has happened somebody, I don't remmeber which forun I read about it. Call them up and inform them that your PD is not current. You can even go to local ASC and talk to an IO. If you have an attorney, inform him/her.
