I am not blaming the Core at all, they are doing whateven they can given the limited resources, time and influence they have. But, what I am blaming, is the the "holier than thou" attitude which is adopted when distinguishing between those that are the exalted DONORS and those that aren't :)

Why can't you see that in last 8 months this nation was going under a presidential election and nothing got done on any issue, other than bailouts and budget? Why can't you see that nothing has happened in the Congress on immigration for any other group? Why can't an highly skilled highly educated chanakya of this planet not see that it is ok for everyone to praise some immigration lawyers who are known to deliberately delay green card application, but its not ok to ridicule someone sincerely working to fix my issue? Why is it ok for me to track my application all day and not complain even once when some tracker website is asking for money to have my question from a lawyer, but will not leave any stone unturned to put the "burden of proof" of innocence on someone sincerely working to stand-up for me because I am too coward to stand-up for myself?

This press release only shows that it is an administrative/executive fix. Either it is USCIS or DOS or the President, is what I do not know. But clearly, it is something not mandated by legislation, else USCIS/DOS would be breaking several laws by continuing to use the old bulletein.

Experts,
I have done e-filing for my AP renewal. I read the instructions to see what documentation I need to mail,but I did not find any documentation specifically for e-filing. Does this mean that there is no need to send any documents? I heard USCIS will take picture during biometrics which is all they need. Can you please share your experiences on this. thanks a lot.

BharatPremi -- On what basis are you saying that? There are 1000s and 1000s of L1 VISA holder from India....there are at least 30,000 H1-B that come from India every year, most of them file under EB-3 category and then have wives and kids and they consume visa number.

PD, I don't agree with the phrasing of the new Labor Cert clause. That is not how I read Frist's bill. Did you make up the new labor cert clause yourself?

I too had very bad experience with Air India, the aircrafts are in bad shape, very poor customer service. I stopped taking Air India after couple of bad experience. I take Jet Airways now, they are pretty good, friendly hostess and good customer service.

This is a great finding I've read that page, but never noticed the Secretary of DHS specifically mentioned Pre-Application of AOS. Now that they do have this in their mind, can we start working on that? I'd love to share a few thoughts I have on it:
From the lessons we learnt from the past, the most important thing for this admin fix to fly is compromise: there must be kind of restriction for the pre-application AOS. A few examples I could think of are:
- The person has been in the country LEGALLY for more than a number of years, OR
- The PD are more than a certain number years old, OR
- I-140 has been approved, OR
- Must have MS or higher for a US college (just for argument's sake, please don't flame me).
The key is to not allow everyone to file pre-application or it'll be drown in a media storm and draw backfires. Yet it gives you a certain promise that you'll be able to file pre-application once you are here for a certain period of time, so everyone has hope and those who has suffered more would have an almost certain chance to do so.
IV core, should we work on this? This is the first time we see pre-application of AOS appears in official file and I believe it's a great opportunity.

Employee of company A accepts an offer from another company B which promptly applies for a H1B transfer premium processing and its approved. Now the employee cannot join company B due to some problem and wants to remain with company A. Does company A need to apply for H1 transfer?
As I understand there will be no need to apply for the transfer again and the employee can continue working for company A. But the tricky part here is what if company B cancels the employees H1 visa seeing the employee did not join its workforce (considering that it just transferred it)?
Can some knowledgeable people please comment on the above scenario please.
Since you have not joined company B then why you worry whether they cancel H1b or not. As long as company A is having your H1b, nothing to worry & no need for reapplying for H1b transfer back to company A. There is no concept of H1b transfer, every company apply a new H1b when you join them and employer/employee relationship exist as long as they don't cancel H1b. Hope this helps.

Since you have not joined company B then why you worry whether they cancel H1b or not. I would like to clarify - anything beyond 0 minutes late is rude. I have a management position in my job, and if that happens at a meeting i'd set up professionally, they get a verbal lashing from yours truly.
