I would definitely agree that even if CIR comes back it has lot of negative things for people who are comming legally like us. We need to think of a different strategy which does not require a legislation which brings lot of attention against us. I can personally say that I will atleast add 10 more members with recurring contributions in a short time. Right now I will double or triple by monthly recurring contributions. I do agree with the core members that we do need lot of money now to lobby. There are are communities which I don't want to say publicly - even though there are in small numbers they have laws passed in favour of them. It is very simple - we need the MONEY POWER

The updates are provided periodically on forums from IV core. We are currently working on the House side for pushing SKIL forward. There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.
We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.
We try not to restrict free voice and opinion from members on forums however, if it gets downright nasty we will edit posts and censor. But in principle we try to avoid it as much as possible.

Again, there is a common misconception that companies have unlimited access to talent in other countries, and the only limiting factor is the quota of H1B visas.
Not true, by a long shot.
To give a simple example, our company is looking for people in Australia, Denmark, Finland, Canada and UK since the pool of qualified people in India has dried up in our field. Can anyone guess where is the biggest talent pool? Nope, not in Bangalore, its right here in USA!! Not all companies are looking for the cheapest person. They are looking for the best person. And in many cases, the best person is already here, and has gathered more experience over the years working for US companies. But they cannot hire her, simply because she is on a visa and thereby beholden to another company. If she had a GC, that would free up the talent pool and thereby make many companies less reliant on H1Bs. Increasing GCs for EB candidates has the same effect as increasing H1 quota, with the added benefit of making the cream of the crop available and reducing the uncertainty and hassle of hiring an H1.
This is why it is in the best interest of companies to support EB GCs.
My friend Senthil makes the same mistakes (repeatedly, unfortunately):
(A) Assuming that "good" companies will not be affected by any change of increase in fees for H1B, since they presumably have unlimited pockets and unlimited access to unlimited talent. (Big ha!ha!)

I understand - I took it all as a healthy debate, I certainly didn't intend to offend anyone. Its been one of the most interesting debates I've had in a while. Hermione, I sincerely apologize if any of my posts have been interpretted otherwise.
I agree completely with Hermione. Look at the data. It is clear that USCIS is processing applications "quickly" (I quote the "quickly" because I mean relative to other bureaucracies).
The average time for processing (not including NC, since that isn't within USCIS control, is approximately 120 days). The goal is 180 days, so they are meeting targets (you can argue about the target if you like, but in Canada the processing is more like 220 days).
The stupidity of giving more and more money to USCIS to speed-up processing, when they are already meeting the targets can not be overstated. The problem is not with USCIS, it is with the fact that there aren't enough visas, and that NC process can take years. If you want an answer to "the problem" you need to make sure you are asking the right question...
Of course, USCIS management doesn't complain about the additional funds they keep getting (what self respecting bureaucrat would?).
Quite frankly, I have dealt with many bureaucracies in my life, and USCIS is amongst the most efficient I have ever encountered (I am not sure if they are efficient per dollar spent, but ignoring what they cost, they deliver pretty darned good service for a government agency).
If users keep (wrongly) insisting that USCIS is the source of the problem, then congress will keep throwing more money at them (and USCIS will happily accept it), and that little slice of the time that USCIS is responsible for will keep getting smaller, but it won't do you (or me) any good, since the lack of visas is the real problem.

We have seen in the past years EB3 ROW got huge visa bonanza at the cost of EB2 I & C. And now apparently EB2 I & C is getting rightly deserved visa bonanza.
How about asking DOS to give similar visa numbers to EB3 I & C as a one time exception. I know people will say it is against law, but in my opinion law is fuzzy enough for this to happen.
DOS can give explanations like "Visa numbers will be given to oldest PDs or some thing". Per my calculation EB3 I needs 68K visas to move past 2003.
We (IV) may have to make representation to Secretary of State and try and convince her.

Again, Thanks a bunch Desi3933. My case is pretty much same as 'Scenario 1' in this Murthy document.
Desi3933 cleared the 99% of the cloud surrounded this issue by pointing to murthy.com (I maintained valid status with 'Employer #2' and this doc says I am good to go). Thank you very much Desi3933.
Apologize for extending the topic....but one of the 'still open' question is what if the Second Employer H1B is 'NEW' and what if it is 'Transfer'.
Murthy document does not say about the Company B H1B is NEW or TRANSFERRED.
If New H1B and Transferred H1B are same....then problem is solved.

Hi guys, I really need your advice on this :
1)Working for a large financial consulting firm A now, in-house lawyers dealt with the H-1B, renewing it now for Oct this year (sent in May, haven't heard back).
2)Want to join a 7-people Start Up company B as a financial analyst, which does not want to hire me as an "employee" but only as a "consultant" (i guess understandable for tax/risk reasons as the president of the firm is also hired as a consultant so ...).
3)How can I keep my H-1B with me? Can company B sponsor me as a consultant? or I need to have a third party consulting firm as a bridge? If so, any good agent or lawyers I can talk to?
Any advice highly appreciated.

Congratulations to all IV members for being able to apply for I-485. This is GREAT news. Please please apply for your I-485 at the earliest. It would be best if your application reaches USCIS in the week of 2nd July. Here is the link to July Visa Bulletin:
